The operation entity of "Dokii", (hereinafter referred to as "we" or "Dokii"), hereby specifically reminds you (the user) to carefully read this User Agreement (hereinafter referred to as "the Agreement") and ensure that you fully understand the terms and conditions in this Agreement before you register as a user. Please read carefully and choose whether to accept or not accept this Agreement. Unless you accept all the terms in the Agreement, you have no right to register, log in or use the Services covered by the Agreement. Your registration, login, use and other behaviors will be deemed as acceptance of this agreement, and agree to be bound by the terms of this agreement. When using the Services, you will also be bound by Dokii's Privacy Policy, Community Covenant, and you will be bound by other guidelines or rules posted on the Services or provided to you, or applicable to specific services and features disclosed to you in connection with such services. This agreement stipulates the rights and obligations between Dokii (hereinafter referred to as "we" or "Dokii") and users regarding Dokii software services (hereinafter referred to as "service"). "User" or "you" refers to the individual who registers, logs in, and uses this service. After "Dokii" modifies the terms of the agreement, if the user does not accept the modified terms, please immediately stop using the Services provided by "Dokii". Users' continued use of the Services provided by "Dokii" will be deemed to have accepted the modified agreement. The Service is not intended for anyone under the age of 18. By using the Services, you agree that: (1) You must be of or above the "Minimum Age" (described below); and (2) You are not already restricted by Dokii from using the Services. It is a violation of our Terms to create an account using false information, including accounts registered on behalf of another person or someone under the age of 18. "Minimum age" means 18 years old. However, if the laws in your jurisdiction require you to be over a minimum age for Dokii to lawfully provide services to you without parental consent (including using your personal data), then the minimum age is that age.
I. Account management
Users need to register a "Dokii" account before using the software and services. The "Dokii" account needs to be registered or bound to a third party or mobile phone number. Users are requested to use a third party or mobile phone number that is not bound to any "Dokii" account, and a third party or mobile phone number that has not been blocked by Dokii in accordance with this agreement. The ownership of the "Dokii" account belongs to "Dokii". After completing the application and registration, user can obtain the right to use the "Dokii" account. The right to use belongs only the initial applicant and may not be given, lent, leased, transferred or sold. Please ensure that the information you provide to Dokii upon registration and at all other times is true, accurate, current and complete. Users can inquire, change, delete and cancel the personal data and registration information on the "Dokiii" account through the "My" page. However, it should be noted that the text and images stored in the system will also be deleted when the relevant information is deleted. This risk is borne by the user. Users shall be responsible for the security of their registered account information and account password. Users shall be liable for account theft or password theft due to improper safekeeping. The user shall bear legal responsibility for the actions under the registered account and password. User agrees not to use another user's account or password under any circumstances. Users agree to notify Dokii immediately if they suspect someone else is using their account or password. Users shall abide by the terms of this Agreement and use the Service correctly and appropriately. If a user violates any terms of this Agreement, Dokii has the right to interrupt or terminate the Service provided to the user's "Dokii" account in breach according to this Agreement after notifying the user.
II. Service content
Specific content of the Service is provided by “Dokii”according to the actual situation, including but not limited to authorizing users to text messages, add friends, have voice chat using their accounts, and other functions and Services. “Dokii” may make changes to the Services provided and content of the Services provided by “Dokii” may change from time to time;
III. User generated content
User Generated Content mentioned in this article refers to any content released by users during the use of the Service, including but not limited to account picture, name, personal signature and other registration information, text message and related link pages, as well as other content generated by the use of account or generated during the Service. Opinions expressed by other users on the Services, do not reflect our views or values. Users shall not use Dokii account or the Service to post the following contents that might interfere with daily operation of Dokii or infringe upon the legitimate rights and interests of other users or third parties:
(1)Sexual Content and Profanity
We don't allow users to promote sexual content or profanity, including pornography, or any content or services intended to be sexually gratifying. We don’t allow apps or app content that appear to promote a sexual act in exchange for compensation.
(2)Hate Speech
We don't allow any user to promote violence, or incite hatred against individuals or groups based on race or ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or any other characteristic that is associated with systemic discrimination or marginalization.
(3)Violence
We do not allow the publication of content depicting or promoting unprovoked violence or other dangerous activities. Generally, if the application depicts game fictional violence content such as cartoon, hunting or fishing, it is allowed to be published.
(4)Sensitive Events
We do not allow any user to take advantage of natural disasters, atrocities, health crises, conflicts, deaths or other tragic events, or lack reasonable sensitivity to these events.
(5)Objectionable, Bullying and Harassment
We do not allow any user to publish threatening, harassing, objectionable, abusive or bullying content or promote threatening, harassing or bullying behavior.
(6)Dangerous Products
We do not allow any user to facilitate the sale of explosives, guns, ammunition or specific gun accessories.
(7)Marijuana/Drugs/Substance Abuse
We do not allow any user to facilitate the sale of marijuana or marijuana products/drugs/substance abuse, whether or not such behavior is legal.
(8)Tobacco and Alcohol
We do not allow any user to facilitate the sale of tobacco (including e-cigarettes and pen e-cigarettes), or encourage others to illegally or improperly use tobacco and alcohol.
Dokii is not responsible for any opinions expressed in User Content. Dokii does not endorse any User Content, opinions, recommendations or advice expressed therein, and Dokii expressly disclaims any and all liability in connection with User Content. Dokii has the right to delete any user content that violates the terms of use of the service or the law at any time without the consent of the user. To the fullest extent permitted by applicable law, Dokii reserves the right to remove, filter or edit any User Content posted or stored on the Services at any time.
IV. Service usage statement
Your access to and use of the Services is governed by all terms of this Agreement and all applicable laws and regulations. You agree that you will abide by these Terms of Service and will not: Impersonate anyone or misrepresent your relationship with any individual or entity when using your account and our services for any communication or sharing or posting any content or information. Use or attempt to use another user's account, service or system without our authorization, or create a false identity on the service; Creating, uploading, transmitting, distributing or storing any content including, but not limited to, illegal, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory or otherwise objectionable content; Harm or exploit Dokii users in any way, including through misleading, bullying, threats of violence, defamation, harassment, abuse, fraud, racial or ethnic offense; Cause loss or damage to any person or property. Interfere with or disrupt the operation of the Service or any user's enjoyment of the Service in any way, including uploading or otherwise transmitting viruses, adware, spyware or other malicious code; Remove, circumvent, disable, damage or otherwise interfere with security-related features of the Services or User Content, features that prevent or restrict use or copying of any content accessible through the Services, features that enforce limitations on the use of the Services or User Content, or delete the copyright or other proprietary rights notices on the Services or User Content; Use technical means such as reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or resource files of the Service or any part thereof, unless and only to the extent that such activity is expressly permitted by the laws of your jurisdiction of residence Inside; Modify, adapt, translate or create derivative works based on our Services or using any of our intellectual property rights (including our trademarks, brand names, logos or other page layouts or designs), unless and only if this is expressly permitted by applicable law within the scope of such activities, notwithstanding this limitation; Interfere with or disrupt the Services or servers or networks connected to the Services, or violate any requirements, procedures, policies or regulations of networks connected to the Services; Use technical means to attempt to access any service or area of the Services that you are not authorized to access; Use the software or services for any illegal purpose, or violate any local, state, national or international laws or regulations, including but not limited to laws governing intellectual property and other proprietary rights, data protection and privacy. Your use of the Services is entirely at your own risk, and Dokii takes no responsibility and assumes no liability for any User Content or for any loss or damage arising therefrom.
V. Artificial Intelligence Features
Use of AI Features:
a. This App may incorporate features powered by artificial intelligence (“AI”), such as, but not limited to, chat translation, intelligent summarization of user profiles and behavior, and generation of personalized greeting phrases (collectively, “AI Features”).
b. You understand and agree that the output from AI Features (e.g., translation results, summary content, greeting phrases) is automatically generated based on algorithmic models and may not be entirely accurate, complete, or suitable for all circumstances. We make no warranties, express or implied, regarding the accuracy, reliability, timeliness, or fitness for a particular purpose of the content generated by AI.
c. You are solely responsible for how you use the AI Features and the content generated thereby. For instance, when using AI-generated greeting phrases, you shall exercise your own judgment as to their appropriateness and shall be responsible for the content you send.
Data Usage Authorization for AI Features:
a. To provide you with AI Features, you hereby authorize us and our third-party AI service providers to collect, process, and use specific data provided by you. For details on the types of data and methods of use, please refer to our Privacy Policy.
b. You represent and warrant that any information you provide for the use of AI Features (e.g., chat content for translation) does not infringe upon any third-party rights and does not contain any unlawful, defamatory, obscene, or otherwise inappropriate content.
Content Ownership in AI Features:
a. Ownership of the original data you input into the AI Features (e.g., chat text you enter) shall remain vested in you.
b. Derivative content generated by the AI Features (e.g., translated text, AI-generated greeting phrases), subject to your compliance with this Agreement, may be used by you for its intended purpose within this App.
Limitations and Changes to AI Features:
a. We reserve the right, at our sole discretion, to modify, suspend, or terminate any AI Feature at any time, without prior notice.
b. AI Features may rely on third-party services. Any interruption or alteration to these third-party services may impact the availability or performance of the AI Features.
Prohibition of Misuse of AI Features: You agree not to misuse the AI Features in any manner, including, but not limited to, generating harassing, discriminatory, or unlawful content, or engaging in any activity that may harm our interests or the interests of any third party.
VI. Privacy
"Dokii" is committed to personal information protection together with users. In the process of using Dokii software and related Services, users may need to provide their personal information (including but not limited to their phone number, avatar information, device information, etc.) so that Dokii can provide better Services and technical support to users. Dokii will protect users' rights to browse, modify and delete relevant personal information and withdraw authorization adhere to regulations, and will use encryption technology, anonymization and other technical measures as well as security measures that are compatible with Dokii software and related Services, to protect users' personal information. For more information about user personal information protection, please refer to the Privacy Policy of "Dokii" .
VII. Intellectual Property Statement
The intellectual property rights of the content provided by Dokii in the Service, including but not limited to trademarks, product names, web pages, text, pictures, audio, video, graphics or other distinctive brand features (including any future updates, upgrades and new versions) are owned by Dokii, except in the following cases: the user has legally obtained the intellectual property rights of the published content before using the service. Unless otherwise specially stated, the copyright, patent and other intellectual property rights of the software used by Dokii in providing the Service are owned by Dokii. The copyright or trademark right of the graphics, words or their composition involved by Dokii in the Service, and other Dokii logos and products and Service names (collectively, "Dokii Logo") shall be owned by Dokii. Without Dokii's prior written consent, users shall not display, use or otherwise dispose of the Dokii logo in any way, nor shall they indicate to others that they have the right to display, use or otherwise dispose of the Dokii logo. The aforementioned and any other intellectual property legally owned by "Dokiii" or the relevant advertisers are protected by law, and without the written permission of "Dokii" or the relevant advertisers, users shall not use or create derivative works in any form. You agree not to infringe any intellectual property rights during the use of the product, otherwise, we reserve the right to block access and/or terminate the account of any user who infringes or is accused of infringing any copyright or other intellectual property rights at any time and may pursue legal responsibilities against users according to law. If you have any doubts or complaints about possible intellectual property infringement, please go to [Dokii APP-Me-Help and Feedback] to submit feedback or send an email to dokiiglobal@gmail.com, specifying the allegedly infringing rights and the accused product, and we will deal with it after we receive the feedback. （This email address is for intellectual property and legal issues only. VIII. Disclaimer
Any risk involved in your use of Dokii business is solely at your own risk. The services provided by Dokii are provided on an "as is" basis and we make no warranties or representations about them.Dokii cannot guarantee that the service will fully meet your requirements, nor can we guarantee the timeliness, security and accuracy of the service;Dokii cannot guarantee the quality, timeliness, accuracy or completeness of the services and is not responsible for any consequences that may arise from the use of such services by users. Dokii cannot guarantee that the service will be uninterrupted, and Dokii is not responsible for changes, suspensions, withdrawals or other deficiencies in the service due to force majeure or circumstances beyond the control of Dokii. Dokii does not warrant the accuracy or completeness of any external links that may be accessed using the Services and is not responsible for the content of any linked site or any link contained in a linked site. Nor is Dokii liable, directly or indirectly, for any loss or damage related to the user's use of the service.
IX. Termination of service
To the maximum extent permitted by applicable law, Dokii reserves the right, with or without notice to you, to temporarily or permanently suspend or terminate your user account or restrict your access to some or all of the Services, including: (a) we reasonably believe that your use of the Services violates this Agreement or applicable law; (b) we reasonably believe that you have fraudulently used or abused the Services; (c) we are unable to continue to provide the Services to you for technical or legitimate business reasons. This includes terminating or suspending your ability to access any purchased products or services. To the fullest extent permitted by applicable law, your only remedy with respect to any dissatisfaction with (i) the Services, (ii) any provision of these Terms of Services, (iii) any policy or practice of Dokii in operating the Services, or (iv)any content or information transmitted through the Services, is to terminate your account and discontinue use of any and all parts of the Services, and Dokii shall not be liable for your dissatisfaction
X. Amendments to the agreement
We may revise these terms of the Agreement from time to time, for example, when we update the functionality of the Services, or when regulations change. We will use commercially reasonable efforts to notify all users of any major changes to these terms, such as through a notice on the Dokii platform. However, you should review the Agreement periodically to check for such changes. Your continued access or use of the Services after the new terms are posted constitutes your acceptance of the new terms. If you do not agree to the new terms, you must stop accessing or using the Services.
